Here is the move by Ofori-Atta’s lawyers to block his deportation to Ghana

Lawyers for former Finance Minister, Ken Ofori-Atta, are moving to block any attempt to deport him to Ghana after he was detained by United States immigration officials for overstaying his visa.

Mr Ofori-Atta was arrested on Tuesday by officers of the US Immigration and Customs Enforcement (ICE), a development that could lead to his removal from the country. However, his legal team says steps have already been taken to prevent that from happening.

Speaking to JoyNews, a member of his legal team, Frank Davies, confirmed that lawyers in the United States have filed an application seeking an extension of his stay.

According to him, the request is to allow Mr Ofori-Atta to continue medical treatment he is currently undergoing.

“He’s in the US for medical reasons and is still receiving treatment in consultation with his doctors. He has been advised to stay on and continue the procedures,” Mr Davies explained.

He noted that under US immigration laws, overstaying a visa without approval automatically makes a person’s stay illegal.

“If you want to remain in the country beyond the period granted on your visa, you must apply for an extension. If you don’t, your stay becomes illegal and you risk being deported,” he said.

Mr Ofori-Atta, who served as Finance Minister under the Akufo-Addo administration, is currently facing investigations and charges by Ghana’s Office of the Special Prosecutor.

His lawyers say he has been in the United States since early 2025 for medical treatment, a claim they have consistently maintained.
