AUDIO: What should he do to prove to you that he is sick? – Lawyer of Ken Ofori-Atta
Frank Davies, a lawyer for former Finance Minister Ken Ofori-Atta, has explained why his client did not appear before the Office of the Special Prosecutor (OSP) on June 2 as ordered.

Speaking on Joy FM’s Super Morning Show, Mr. Davies said Mr. Ofori-Atta is unwell and currently receiving medical treatment in the United States.
“If I say I’ll meet you tomorrow but fall ill tonight, would I still come? People know Ken has not been well. Why is it hard to believe he is sick?” Davies asked.
The OSP had warned that if Ofori-Atta failed to show up, he could be declared a fugitive again and face an INTERPOL Red Notice, which might lead to his arrest and extradition.
Background
In January 2025, the OSP named Ofori-Atta as a suspect in five separate cases and asked him to appear on February 10. His lawyers said he was receiving treatment abroad and asked to represent him. The OSP refused and demanded a return date.
When no date was given, he was declared wanted on February 12. His lawyers later provided a medical report showing he might need surgery and didn’t know when he’d return. On February 18, a firm return date in May was given, and his name was removed from the wanted list.
In March, Ofori-Atta sued the OSP and its head, calling the declaration illegal. He also asked the court to order the OSP to delete related posts from its social media. A ruling on the case is expected on June 18.
Current Update
Mr. Davies said they informed the OSP on May 27 that Ofori-Atta’s health had worsened and he could not travel. He also suggested the OSP consider questioning him virtually due to his condition.
